Mercer Island Reaches Out to Feds to Block I-90 Tolls

The city has sent a letter to the Federal Highways Administration to oppose the approval of Interstate 90 tolling.

Mercer Island's legal team has sent a letter to the federal government citing several reason that the government should block tolling on Interstate 90, a federal highway.

The Washington State Department of Transportation has been looking into tolling Interstate 90 to help pay for the State Route 520 Bridge Project. 

The the 520 replacement project is estimated at $4.128 billion and the state still needs to close a $1.4 billion gap in funding, WSDOT officials have said. Officials have also said that congestion has increased and traffic has slowed on Interstate 5, Interstate 90 and State Route 522 as drivers avoid tolls on SR 520.

A toll on I-90 would raise money for 520 and possibly cut down on drivers who clog I-90 to avoid tolls on 520.

The letter by law firm K&L Gates, tells Federal Highway Administration administrator Victor Mendez, that the city believes that allowing WSDOT to toll I-90 possibly would set a precedent that would allow other states to toll any road to pay for another road, instead of maintaining the expectation that tolled roads to pay for the projects on that road.

K&L Gates also said that significant impacts to residents should be considered as part of the environmental impact of tolling I-90 and that the proposal should require a full Environmental Impact Statement.

Reaching out to the federal government is part of the city's strategy for fighting the possibilty of I-90 tolls. The city council developed a plan earlier this month, and included lobbying on the state and federal level and the possibility of lawsuits. The city council agreed to set aside $150,000 from its contingency fund to fight the tolls.

The K&L Gates NO TOLLING I-90 letter to the FHWA is a good start. But it also should have been accompanied with Attachments, including one or more letters signed by 100% of the City Council, the City Manager, MI School board, the MISD Superintendent, and even nearby community political affiliates. It should have also had info copies sent to the US DOT Secretary, Ms. Murray, Ms. Cantwell, and Gov. Inslee. The shot over the bow needs to be widely announced, not just quietly launched. Sending copies to the US DOT Secretary et al, puts the FHWA Administrator on notice that we're willing to play for big stakes in the big leagues on this one, and not just diddle around at the margin, with FHWA.

It will also cut down on the traffic going in to Seattle, stripping the city of commerce and making businesses question whether it is worth their astronomical rents to locate in Downtown. A city is only as good as its location, and destroying your location will destroy your city. Besides, what waste - you have one of the highest gas taxes in the US, nearly a full $1 a gallon higher than Georgia, and still can't make budget? But what's to be expected from a state that spends $1.5 billion for a train that is slower than a bus and has a route shaped like a frying pan! Talk about the necessity of mass-transit all you want, but that doesn't mean that building any messed up, no good, over-expensive system will fix your traffic problems!

This is a great letter and states the case against tolling better than anything I have seen. At the very least it compels WSDOT to do a complete EIS so a decision can be made with all the facts instead of misleading comments such as "Tolling is a done deal". I would recommend that anyone remotely interested in this issue read the letter linked to the above article.

By putting pass scanners on both bridges (main span, east channel), it would be fairly easy to figure out an algorithm that would not charge islanders. That is, if you crossed the main span but didn't cross the east channel within, say, 2 hours, you wouldn't get charged. Those driving straight through would get scanned in both locations within a relatively short period and would get charged.
On the other hand, perhaps people living on Bainbridge or Vashon should be exempt from ferry fares.

The adverse effect of proposed I-90 bridge tolling on MI is serious and real and bad enough, even if dual toll gates and a related delay period were used. We'd end up being one giant park & ride for eastsiders ranging out to Ellensburg. They'll be parking on our hopelessly clogged lots and streets, even illegally, from Luther Burbank to the south end QFC, especially once the ill-advised light rail debacle arrives on MI. But the most critical adverse aspect of this tolling tax goes beyond that. Tolling tax diversion for other purposes sets the terrible precedent for being able to skim off revenue from any interstate highway adjacent to any town or city nationally. Hence the terrible precedent sows the seed for the destruction of the economic utility of the entire interstate highway system. So this proposed I-90 bridge tolling tax simply needs to be stopped dead in its tracks, right here, and right now. Tolling of our I-90 bridge is NOT inevitable, regardless of what Ms. Clibborn and some of her shortsighted colleagues in Olympia, at WSDOT, and in our City Council might assert.

raising tolls again on 520 - by the time the 90 toll comes it's going to be over $5 each way... for our duel income family, that would $20 a day, $400 a month just for roundtrip to work. Whole Foods, Trader Joe's, Costco, $16 before you buy anything,
